Terms and Conditions (T&C) for CRYPTICAL
1. Scope
1.1. These Terms and Conditions (hereinafter “T&C”) apply to all contracts concluded between CRYPTICAL (hereinafter “Seller” or “we”) and the customer (hereinafter “Customer” or “you”) via our online shop on the Shopify platform.
1.2. We do not recognize any terms and conditions of the Customer that deviate from these T&C unless we have expressly agreed to their validity in writing.

3. Conclusion of Contract
3.1. The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order. The Customer’s order constitutes an offer to conclude a purchase contract.
3.2. After receiving an order, you will receive an email from us confirming receipt of your order and containing the order details. This email does not constitute acceptance of your offer; it merely informs you that we have received your order.
3.3. The contract is concluded only when we accept your offer by dispatching the goods or by expressly declaring acceptance by email.
4. Prices and Shipping Costs
4.1. The prices stated in our online shop include statutory value-added tax (VAT) and are subject to additional shipping costs.
4.2. Shipping costs depend on the shipping method, delivery address, and total order value. The exact shipping costs are displayed to you during the checkout process.
5. Payment and Retention of Title
5.1. Payment is made using the methods indicated during checkout. We reserve the right to exclude specific payment methods.
5.2. The delivered goods remain the property of the Seller until paid for in full.
6. Delivery and Delivery Times
6.1. Delivery is made to the delivery address provided by the Customer.
6.2. Delivery times are stated in the respective product listing and may vary depending on the product. If no delivery time is stated, delivery generally takes place within 3–5 business days after the contract has been concluded.
7. Right of Withdrawal and Returns
7.1. Information on the right of withdrawal and our returns policy can be found in our separate “Cancellation Policy and Returns Policy.” These are available on our website.
8. Warranty and Liability
8.1. Warranty is provided in accordance with statutory provisions.
8.2. We are liable for damages in accordance with statutory provisions where intent or gross negligence is attributable to us. In cases of simple negligence, we are only liable for breaches of essential contractual obligations (cardinal duties). In such cases, our liability is limited to the typical, foreseeable damage.
9. Data Protection
9.1. Information on data processing and data protection can be found in our Privacy Policy, available on our website.
10. Final Provisions
10.1. The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
10.2. The place of jurisdiction for all disputes arising from the contractual relationship between the Customer and the Seller is the Seller’s registered office, provided the Customer is a merchant (Kaufmann), a legal entity under public law, or a special fund under public law.
